What you need to know about the Immigrant Investor Program

ID-10060211The EB-5 visa, or the Immigrant Investor Program as it’s widely known, provides a path to citizenship for foreign nationals who invest significant amounts of money in the United States, while creating job opportunities. The program was first introduced in 1990, but it’s not until 2014 that it reached its full potential. Since 1990, foreigners have invested more than $6.8 billion, and the U.S. has given out almost 30.000 visas through the program. Nowadays, the program has become quite popular among wealthy businessmen from all over the world, and especially from China. South Korea, Canada, and Great Britain have also sent numerous entrepreneurs through the program.

In order to obtain the visa, investors must plough in $1.000.000 or at least $500.000 in a Targeted Employment Area, and create and preserve a minimum of 10 jobs for U.S. workers, others than the investors themselves and their immediate family. The program aims to boost the economy in rural areas and to encourage job creation in areas with high unemployment rates.

There is a list of approved EB-5 Regional Centers on the USCIS website, but authorities underline that it doesn’t mean they endorse any of these establishments. Some developers have even formed their own Regional Centers in order attract EB-5 investments.

Foreign entrepreneurs must file Form I-526, which includes all necessary information about the future investment. If the petition is approved, the investor and their derivate family members will be granted conditional permanent residence for a period of two years. Within 90 days before the temporary status expires, the applicant must demonstrate that the full required investment has been made and that at least 10 jobs have been preserved or 10 jobs have been or will be created shortly (Form I-829). If USCIS approves the petition, the EB-5 investor and their family members will become permanent residents of the United States.

Immigrant Investor Program funding has contributed significantly to rebuild local economies in various areas across the country. Las Vegas, for example, has fully enjoyed the benefits of this particular immigration program. Several casinos, such as Downtown Grand, Lucky Dragon, Dynasty Hotel Casino, Clarion Hotel, and World Resorts have been built using foreign capital. Other projects sustained by foreign entrepreneur are The Four Seasons Restaurant in Manhattan, the Hudson Yards Redevelopment Project, the George Washington Bridge Bus Terminal and the New York Wheel.
